Cooley v. Board of Wardens, 53 U.S. 299 (1851) was one of the first cases to discuss the dormant commerce power.  Pennsylvania required any ships entering or leaving Philadelphia to use a local pilot for assistance in navigating the harbor. The question for the court was, can states “regulate interstate commerce regarding highly localized matters when Congress has not created rules in the area with which the state regulations conflict.” The court held that, states “may regulate aspects of interstate commerce that are local in character; the Commerce Clause doesn’t remove from a state all power to regulate interstate commerce, including the regulation of pilots.” Please visit Justia US Supreme Court website for the full text of Cooley below in the Resources for Assessment.
