The importance of patrol officers discretion is powerful. The officers have to take circumstances in consideration when determining an arrest. Existing laws are made for a reason, if there were no laws the officers would make several unnecessary arrest. The police decides who to stop and question, which traffic violators to pursue, and the officers have the right not to arrest for a minor violation. The difference between a full enforcement and selective enforcement, is with the full enforcement the officers make arrest for every violation of the law. The selective enforcement is when the officer rely on the rank-and-file officer to make the call on which law to enforce. The positive discretion of the law enforcement is individuals who violate may get a warning instead of arrested. The officers can also choose which traffic laws to enforce and ignore. The negatives are discretion is based on the officers belief of their work ethic and some officers ignore wrong or horrendous violations.

2. This should be addressed to Sherri Boyd

The importance of discretion used by patrol officers is a very matters concerning criminal justicee. However, police are not always supposed to exercise discretion. In some instances, the law and departmental policies do limit or eliminate the discretion altogether. During training, the police officers are presented with different scenarios that they may come across when they are out on duty. However, the situations are not exhaustive and the police more often than not come face to face with intriguing situations that demand their personal decision.

The advantages of police discretion is the fact that it allows the officer to treat people, giving them a second chance, and improving on the public perception of the police. The long-term effects of police officer attitudes towards the community they serve as a function of officer race and ethnicity play a major role in police discretion (Lasley, Larson, Kelso, & Brown, 2011).

Selective enforcement occurs when government officials such as police officers, prosecutors, or regulators exercise enforcement discretion, which is the power to choose whether or how to punish a person who has violated the law. Selective enforcement occurs when government actors strategically refrain from enforcing a law in order to extort from those subject to the law (Cartwright, 2016).

Full enforcement is, selective enforcement occurs when government officials such as police officers, prosecutors, or regulators exercise enforcement discretion, which is the power to choose whether or how to punish a person who has violated the law.

Positive of police discretion in law enforcement is people who violate laws may get a warning instead of a citation or arrest, fewer jails, jail officers, or police officers are needed, and officers may choose what type of traffic violations to enforce or ignore.

Negatives of police discretion in law enforcement Discretion is applied based on the officer’s belief system .One person may get a warning for an offense while a second person gets cited or arrested for the same offense. Allows some officers to ignore flagrant or egregious violations or crimes out of laziness.
