Criminal Justice

PART 1

Intermediate sanctions span a large gamut, and can be administered primarily by the judiciary, in probation, in institutions, or in the community. There are many complexities associated with intermediate sanctions. Some challenges include determining who should operate intermediate sanctions, with options including probation, parole, institutional corrections, or new agencies (public and private). Selecting offenders is also a source of challenge, in terms of offense severity and/or offender problems.

Understanding the different complexities of intermediate sanctions is important in order to best utilize this approach to punishment.

In 250-300 words answer the following:

  • Summarize three challenges associated with intermediate sanctions.
  • Predict three impacts that could result from your identified challenges.
  • Propose one solution for managing each identified challenge.
  • Explain the importance of criminal justice professionals understanding intermediate sanction challenges.

If possible, use the American Corrections textbook, Chapter 9.

PART 2

Certain circumstances must exist for a search to be constitutional. For example, contemporaneous searches must occur at the time as, or very close in time and place to, the arrest. Searches citing exigent circumstances may involve some kind of an emergency that makes getting a search warrant impractical, useless, dangerous, or unnecessary. There is generally a reasonable expectation of privacy that exists when a person exhibits an actual expectation of privacy, and the expectation is one that society is prepared to recognize as reasonable. That aside, the U.S. Supreme Court held in United States v. Place, that there is no search within the meaning of the 4th Amendment if police use narcotics detection dogs to smell closed containers for drugs, as long as police are on the premises legally.

Instructions

Consider that there is no need for a search warrant or for probable cause to conduct dog sniffs.

In 250-300 words answer the following:

  • Express your position on the Court’s decision in United States v. Place, using an additional case to support your opinion.
  • Describe the constitutional requirements that apply, or do not apply, in canine searches.
  • Differentiate between the constitutionality of canine searches versus other searches that require probable cause.

PLEASE USE THE BULLET/QUESTION ABOVE AS THE TITLE OF THE PARAGRAPH!! THERE ARE 3 BULLETS/QUESTIONS ABOVE, SO THERE SHOULD BE 3 PARAGRAPHS.

PART 3

Drug testing elementary and high school students taking part in athletics and other school programs is valid. In the case Vernonia School District 47J v. Acton (1995), the Court upheld random drug testing of high school athletes. In the subsequent case Board of Education of Independent School District No. 92 of Pottawatomie County et al. v. Earls (2002), the Court extended that ruling to middle and high school students participating in any extracurricular activity.

Instructions

Locate a case dealing with random drug testing of elementary or high school students.

In 250-300 words answer the following:

  • Explore the Court’s reasoning that drug testing is a minimal intrusion to students.
  • Assess whether the interests of the government in this line of cases are important enough to override the individual privacy protection.
  • Articulate whether you, as a criminal justice professional, believe these rulings should also extend to college students.

The Law and Policy Making in the New Economy:

The nature and structure of work and the relationship between employers and workers have been changing significantly over the last two or three decades, and particularly more recently. These changes have been termed “the new economy”, with the result that the regulation of the workplace and of employer-employee relationships previously developed are no longer relevant in many situations. This course will address the major characteristics of and the process of developing policy to respond to the new economy, and considers what changes may be required to ensure the new economy meets the needs of all participants, employers and workers.

Among the major changes are the following: the move towards post-industrial, service-based work; increased contracting out and off-shoring of work as a result of greater economic integration; the decline of the “standard employment relationship” based upon full-time, long-term employment, with regular hours and benefits, and the rise of part-time, temporary and contract work and self-employment, much of which is “precarious”; rapid technology change; and the increasing diversity of the workforce. We see a decline in unionization levels and thus of collective bargaining; certain demographic patterns among workers without any or adequate access to employment protection legislation; worker displacement through the decline in Canadian manufacturing and the impact of technology; a more complex relationship between requirements of family and work; and employers’ need for increased flexibility in the employment relationship

Data Presentations – Business Analysis in Motion Picture Industry

The motion picture industry is a competitive business. More than 50 studios produce a total of 300 to 400 new motion pictures each year, and the financial success of each motion picture varies considerably. Gross sales for the opening weekend, the total gross sales, the number of theaters the movie was shown in, and the number of weeks the motion picture was open are common variables used to measure the success of a motion picture. Data collected for a sample of 100 motion pictures produced in 20XX are contained in the file named Movies, linked at the bottom of the page. Use all 100 data points.

Managerial Report
Prepare a report (see below) using the numerical methods of descriptive statistics presented in this module to learn how each of the variables contributes to the success of a motion picture. Be sure to include the following three (3) items in your report.

  1. Descriptive statistics (mean, median, range, and standard deviation) for each of the four variables along with an explanation of what the descriptive statistics tell us about the motion picture industry.
  2. Use the z-score to determine which movies, if any, should be considered high-performance outliers in each of the four variables. If there are any outliers in any category, please list them and state for which category they are an outlier. Describe which method you used to make your determination.
  3. Descriptive statistics (correlation coefficient) showing the relationship between total gross sales and each of the other three variables. Evaluate the relationships between total gross sales and each of the other three variables. Use tables, charts, graphs, or visual dashboards to support your conclusions.

An example paper is provided in the MTH410 Guide to Writing with Statistics, linked at the bottom of the page.

Your report must contain the following:

  • A title page in APA style.
  • An introduction that summarizes the problem.
  • The body of the paper should answer the questions posed in the problem by communicating the results of your analysis. Include results of calculations, as well as charts and graphs, where appropriate.
  • A conclusion paragraph that addresses your findings and what you have determined from the data and your analysis.

Submit your Excel file in addition to your report.
