From the e- Activity, select two (2) U. S. Supreme Court decisions that impacted the manner in which the juvenile justice system handles juvenile delinquency. Describe the significant manner in which the court rulings in juvenile delinquency cases have altered the judicial system treatment of juvenile as compared to the treatment of adults.

Support or critique the notion that juveniles who commit serious crimes should face adults sanctions.  Next discuss whether or not the juvenile justice system should be used exclusively for youths who engage in minor offenses.  Justify your response.

Duress

Johnny, the CEO of Plastic Spoon Inc., is in a bit of a bind.  His daughter was kidnapped.  The kidnappers are demanding a hefty ransom.  Unfortunately for Johnny, he cannot afford the ransom. So, Johnny withdraws the ransom money from Plastic Spoon’s account, and he pays the kidnappers.  After returning with his daughter, the directors of the corporation notice the missing funds.  The directors report the loss to the police. The directors suspect that Johnny misappropriated the funds, and they tell the police about their suspicions. The police search Johnny’s home without a warrant.  They find a letter Johnny was writing that confirms that Johnny took the money for the corporation to pay the kidnappers.  The police arrest Johnny, and he is charged with theft.  Johnny is charged with embezzlement.

The elements of embezzlement in this state are: The intentional taking of money or property by a CEO or other top official in a corporation without consent.

• Are the elements of embezzlement present in this fact pattern?  
• What affirmative defenses can Johnny raise?  
• Can Johnny get the letter seized by the police suppressed?  Why?

TCI case

Pamela, marketing manager at TCI, Inc., is very irritated. She spent the whole summer designing a marketing strategy, and according to independent tests, the campaign has, beyond a reasonable doubt, proven to be effective in achieving the objective of retaining customers.  Over the last 2 years, it has been observed that the average percentage of customers leaving TCI and moving to a different company is about 20% of the existing customer base, and at this speed TCI will end up losing a lot of customer and money.  It is a well-known fact that it costs much more money to acquire a new customer than retaining an existing one so she does not understand Robert who is saying that the promotion Pamela is suggesting will cost a fortune.  The promotion consists of giving existing customer a monetary reward so they stay with TCI.  Robert says that even though he agrees that that the campaign works, it should not be implemented because the cost does no justify offering the incentive to all existing customers.  Pamela insists that you have to see the long-term implications of the initiative and not the short-term investment but Robert does not believe in Pamela’s crystal ball.  He keeps saying: “show me the money” and I will agree.
