Literature Review

For Week 5, locate two additional scholarly articles related to your topic. Summarize the articles in your own words and explain how they are related to your topic. Do not use published cases for this section. You must use scholarly articles from the South University Online Library. Legal journals may provide some of the best sources of information.   Westlaw Campus Research is a good option for finding legal information in law journals.  When you combine this section with Week 3, you will have a total of at least four articles.

Laws and Regulations

Research and analyze one additional law or regulation related to the topic you selected. The information may require research of federal and/or state laws, as well as administrative agency laws.  Summarize the information about the law or regulation you found and explain how it applies to your topic.  When you combine this section with Week 3, you will have a minimum of two laws or regulations.  Depending on the topic, you may compare the laws of two states For example, if you are writing about gender discrimination, compare the federal law with law from one of the states that also provides protection at the state level. States often provide more protection than the federal law.

Cases

Research at least two additional published cases (lawsuits) related to the topic you selected.   Summarize the cases in your own words and explain how they are related to your topic.  Provide a summary that includes the name of the case, state or federal court, issue, summary of events and ruling.  Explain whether you agree or disagree with the court’s decision.  Combine the case from Week 3 with this section for a total of three cases.

Summary/Conclusion

  • As an ending to your paper, summarize what you have learned. Assess and communicate what you believe the future holds as it relates to your topic.
  • If applicable, discuss how you might apply what your learned to your personal or professional life.
  • Add the parts from Week 3 and submit your final paper in accordance with the formatting instructions provided.

Virgin Mobile USA: Identifying a Target Market

Richard Branson enlisted Dan Schulman to become the CEO of Virgin Mobile USA, a newly formed start-up in highly competitive and mature industry.

One of the first tasks that Dan had to accomplish was to choose his target market.  After getting loads of data from IDC and Salomon Smith Barney, and studying it for several weeks, he noticed that among consumers aged 15-29 penetration rate was around 45% versus about 50% for general population.  Also the growth rate for this particular group was predicted to be strong in the next 5 years.

“Why haven’t the big players targeted this market?” Dan asked himself.  One reason was that young consumers often didn’t have good credit history and didn’t pass the credit checks required by cell phone contracts. Another reason was that the cell phone companies were wary to acquire low value subscribers, because their average cost of acquiring customers was about $370 per customer and they were afraid that this group would be unprofitable for them.

Despite these challenges, Dan’s team decided that this segment of the market represented the greatest opportunity.  Schulman explained: “This is a market that has been underserved by the existing carriers.  They have specific needs that haven’t been met.”

After more marketing research, Dan’s team was able to compile an average profile of their target customer:

A lot of the consumers in this age group are in flux in their lives. They are either in college, they are just leaving their home, or they may be getting their first cell phone.  Their usage is probably inconsistent. One month, they may not use the phone at all, and another month, they may use it quite a bit, depending on whether they are on vacation or in school.

Their calling patterns are different from the typical businessperson. They are more open to new things, like text messaging and downloading information using their phones. And they are more likely to use ring tones, faceplates, and graphics.  Phones are more than a tool for these young people; they are a fashion accessory and a personal statement.

Discussion: Evaluating Use of Literature and Problem Statement

Researchers use scholarly literature for various purposes in their work, such as, but not limited to, establishing the need for and importance of their study or describing a theory. The problem statement is typically tied to the literature, and for this reason, these two components of research are presented together this week; this connection among research components will be a recurring theme throughout this course.

For this Discussion, you will evaluate the use of literature and problem statements in assigned journal articles in your discipline to understand what it means for a research study to be justified, grounded, and original. Week 3 Assignment

The following scenario is based on an actual attack deconstructed at a seminar I attended earlier this year. The names and locations have been removed to preserve the privacy of the organization in question.

Background:

No-Internal-Controls, LLC is a mid-sized pharmaceutical company in the Midwest of the US employing around 150 employees. It has grown over the past decade by merging with other pharmaceutical companies and purchasing smaller firms.

Recently No-Internal-Controls, LLC suffered a ransomware attack. The company was able to recover from the attack with the assistance of a third party IT Services Company.

Attack Analysis:

After collecting evidence and analyzing the attack, the third party was able to recreate the attack.

No-Internal-Controls, LLC has a number of PCs configured for employee training

These training computers use generic logins such as “training1”, “training2”, etc. with passwords of “training1”, “training2”, etc.

The generic logins were not subject to lock out due to incorrect logins

One of the firms purchased by No-Internal-Controls, LLC allowed Remote Desktop connections from the Internet through the firewall to the internal network for remote employees

Due to high employee turnover and lack of documentation none all of the IT staff were aware of the legacy remote access 

The main office has only a single firewall and no DMZ or bastion host exists to mediate incoming remote desktop connections

The internal network utilized a flat architecture

An attacker discovered the access by use of a port scan and used a dictionary attack to gain access to one of the training computers

The attacker ran a script on the compromised machine to elevate his access privileges and gain administrator access

The attacker installed tools on the compromised host to scan the network and identify network shares

The attacker copied ransomware into the network shares for the accounting department allowing it spread through the network and encrypt accounting files

Critical accounting files were backed up and were recovered, but some incidental department and personal files were lost

Instructions:

You have been hired by No-Internal-Controls, LLC in the newly created role of CISO and have been asked to place priority on mitigating further attacks of this type.

· Suggest one or more policies that would help mitigate against attacks similar to this attack

· Suggest one or more controls to support each policy

· Identify each of the controls as physical, administrative, or technical and preventative, detective, or corrective.

· Keep in mind that No-Internal-Controls, LLC is a mid-sized company with a small IT staff and limited budget

· Do not attempt to write full policies, simply summarize each policy you suggest in one or two sentences.

Juan is scheduled for a laparoscopic Lap-Band placement surgery. He meets with the surgeon one week prior to the surgery. The surgeon explains the surgical procedure and how the Lap-Band is used. She asks Juan if he has any questions? Juan says “no.” On the day of the surgery, while Juan is being prepped, a nurse walks in to obtain his consent to treat. To verify, the nurse asks Juan if the doctor explained the procedure, including the risks and benefits. Juan looks surprised and replies, “what risks?”

Public Health Discussion


The epidemiology of chronic disease is complex. Most often the distribution of a chronic disease does not follow a simple pattern.The determinants of a chronic disease are multifactorial involving biology and genetics, individual behavior, health policy and service, and social factors including built environment.

The built environment consists of man-made physical and social structures including housing, workplaces, transportation, and neighborhood (e.g., sidewalks, recreation area, and crime). You spend nearly all of your time in the built environment. Emerging evidence increasingly recognizes that your built environment affects your health (Srinivasan, O’Fallon, & Dearry, 2003). However, a causal relationship between the built environment and specific chronic disease is sometimes difficult to ascertain.

For this Discussion, focus on the impact of built environment on chronic diseases. Select a chronic disease and analyze the epidemiology of the disease in your community. Then consider different theories and think about which one might best describe the occurrence of the chronic disease you selected. Finally, think about an initiative focusing on the built environment that might reduce the burden of the disease in your community.

With these thoughts in mind:

Post a descriptive epidemiology of the chronic disease you selected. Then briefly describe the social determinants of the disease in your community. Describe a theory that best explains the occurrence of this disease.
